BOARD OF CITY COMMISSIONERS PROCEEDINGS

MARCH 20, 2000 AT 7:30 P. M.

The Board of City Commissioners of the City of Shawnee, County of Pottawatomie, State of Oklahoma, met in Regular Session in the Commission Chambers at City Hall, 9th and Broadway, Shawnee, Oklahoma, Monday, March 20, 2000 at 7:30 p.m., pursuant to notice duly posted as prescribed by law. Mayor Harden presided and called the meeting to order. Upon roll call, the following members were in attendance.

AGENDA ITEM NO. 1: Consider Approval of Consent Agenda.

A motion was made by Commissioner Young, seconded by Commissioner Roach, that the Consent Agenda (a-g), be approved. Motion carried.

AGENDA ITEM NO. 2: Mayor’s Proclamation.

Mayor Harden issued the following proclamation:

“Working Together For A Literate Oklahoma”
Adult Literacy Month - April, 2000
(accepted by Ann Davis and Robin Mikles, Literacy Coordinator for Pioneer Library System)

AGENDA ITEM NO. 3: Public hearing and consider an ordinance to annex property located in the 3900 block of North Bryan.

Mayor Harden declared a public hearing in session to consider an ordinance to annex property located in the 3900 block of North Bryan for use of developing residential housing.
Mayor Harden asked if any persons wished to appear in favor of or in protest of said rezoning. No persons appeared.
It was noted that the Planning Commission had deferred action to its April 5, 2000 meeting to allow staff time to contact another property owner regarding the annexation; and staff recommended to the Commission to defer this item to a subsequent meeting.
A motion was made by Vice Mayor Downing, seconded by Commissioner Gillham, to defer this public hearing annexing property located in the 3900 block of North Bryan to the April 17, 2000 City Commission meeting. Motion carried.

AGENDA ITEM NO. 4: Consider approval of contract between State of Oklahoma Department of Civil Emergency Management and City of Shawnee for sub-grant program.

Mr. James Roberts, Fire Chief/Emergency Management Director, reported to the Commission that this was the same contract as last year and the agreement will allow the City to receive funds for its emergency management program.
A motion was made by Commissioner Roach, seconded by Commissioner Winrow, to approve the contract between the State of Oklahoma Department of Civil Emergency Management and the City of Shawnee for the State and Local Assistance sub-grant program in the amount of $44,834. Motion carried.

AGENDA ITEM NO. 5: Consider options for employee health insurance and related benefit coverage for FY 2000-2001, and authorize city staff to solicit proposals.

Personnel Director Allen Benelli presented to the Commission an overview of the history of the health plan. He stated that City employees have participated in the Oklahoma State and Education Employees Group Health Insurance Plan since January 1, 1998.
He advised that when the Commission requested staff to solicit informal bids from local insurance agencies last year, the premiums were close to the State Plan, but the State still provided the best coverage and the City remained with the State Plan.
Mr. Benelli stated that with the prospect of future increases in the State Plan, it was staff’s recommendation that other options be explored and staff be authorized to solicit for propsals.
A motion was made by Commissioner Roach, seconded by Vice Mayor Downing, to authorize staff to solicit proposals for employee health insurance coverage and related benefits for FY 2000-2001. Motion carried.

AGENDA ITEM NO. 6: Consider a resolution declaring certain items of personal property surplus and authorizing the sale thereof by public auction.

Resolution No. 6062 was introduced and the title read aloud.

Resolution No. 6062 entitled “A resolution declaring certain items of personal property surplus and no longer needed for City purposes; describing said items; authorizing the sale thereof pursuant to public auction; setting forth requirements as to notice.”

A motion was made by Commissioner Winrow, seconded by Commissioner Young, that the Title and Resolution be approved. Motion carried.

The City will have the public auction on Saturday, April 15, 2000 at the Public Works Facility.
AGENDA ITEM NO. 7: New Business.

Commissioner Roach requested staff to contact the State Highway Department for improving the exit ramp signs off Interstate 40 at Harrison Street.
AGENDA ITEM NO. 8: Citizens Participation (A five minute limit per person) (A fifteen minute limit per topic)

There was no Citizens Participation.

AGENDA ITEM NO. 9: Consider an Executive Session for the purpose of discussing pending litigation in Harris vs. the City of Shawnee, C-99-804, District Court of Pottawatomie County, pursuant to 25 O.S. 1992, Section 307(B)(4).

A motion was made by Vice Mayor Downing, seconded by Commissioner Claybrook, that the Commission go into Executive Session for the purpose of discussing pending litigation in Harris vs. the City of Shawnee, C-99-804, District Court of Pottawatomie County, pursuant to 25 O.S. 1992, Section 307(B)(4). Motion carried.

CITY COMMISSION NOW IN EXECUTIVE SESSION AT 7:49 P.M. WITH ALL COMMISSIONERS PRESENT.

CITY COMMISSION NOW RECONVENED IN REGULAR SESSION AT 8:07 P.M. WITH ALL COMMISSIONERS PRESENT.

AGENDA ITEM NO. 10: Consider action concerning matters discussed in Executive Session regarding pending litigation.

Mayor Harden stated that the purpose of the Executive Session had been to receive information regarding the pending litigation in Harris vs. City of Shawnee and no action was taken.
AGENDA ITEM NO. 11: Administrative Reports.

There were no Administrative Reports given.


AGENDA ITEM NO. 12: Commissioners’ Comments.

There were no Commissioners Comments.

AGENDA ITEM NO. 13: Adjournment.

There being no further business to come before the meeting, a motion was made by Vice Mayor Downing, seconded by Commissioner Roach, that the meeting be adjourned. Motion carried.
