6. Consider appeal of Jack Cupp of the Administrative Hearing Officer’s order regarding property located at 633 W. Dewey. Pgs. 73-85

On December 4, 2003, the Hearing Officer ordered that the structure be secured immediately and that a rehab permit be obtained prior to February 5, 2004 and all construction complete by May 6, 2004. No permit was obtained, so a second hearing was scheduled for February 19th. At that hearing, the case was continued until March 4th to obtain all electric and plumbing permits required for the construction. On July 22, 2004, a third hearing was held where the Hearing Officer concluded that the dwelling should be condemned and ordered that the structure be razed and removed. The structure can and should be remodeled, but the owner hasn't cooperated with city staff in this process.

7. Consider appeal of Ronnie Golden of the Administrative Hearing Officer’s decision regarding property located at 431 N. Aydelotte. Pgs. 86-93

This property was condemned and ordered to be razed and removed at a July 29, 2004 hearing. The owner failed to adhere to a previous order to obtain a rehab permit by June 1, 2004 and clear the lot of trash and debris within 10 days. No permit was ever obtained nor has the property been cleaned.

8. Public hearing and consider an ordinance to rezone property located at 7906 N. Kickapoo from A-1; Agricultural District to A-1P; Agricultural District with Conditional Use Permit to allow a manufactured home on location. (Applicant: Claude & Sammie Davidson) Pgs. 94-101

The Planning Commission recommends approval of the Conditional Use Permit to locate a manufactured home in A-1, Agricultural, with the condition that it be removed within 5 years. The applicant agreed to the condition because the need for the dwelling is to allow his granddaughters to attend OBU. The youngest will be a freshman this fall.

9. Public hearing and consider an ordinance to rezone property located at 1701 Airport Drive from R-3; Multi-Family Residential District and C-3; Automotive and Commercial Recreation District to Planned Unit Development (PUD) with mixed zoning to permit commercial and multi-family residential development. (Applicant: Terry Carty/Carland Development) Pgs. 102-112

The Planning Commission recommends approval with the requirement that a fence be constructed around the R-3, Multi-family, area when it is constructed. There is a sight-proof fencing requirement tied to commercial development when it abuts residential. The PUD varies the minimum frontage requirements of R-3 and C-3 and the sight-proof fencing, but will provide more landscaping and establishes minimum design specifications. The developer proposes to improve the city's existing detention area to the north, which will alleviate many of their drainage problems. An agreement will be brought to the Commission at a later date.


10. Consider approval of final plat of “Legacy Park” located at 1701 Airport Drive. (Applicant: Terry Carty/Carland Development). Pgs. 113-124

The Legacy Addition Final Plat is a single lot subdivision representing the R-3 (multi-family) area in the middle of the overall development. The proposal is to relocate some internal public water lines and to redirect a store sewer line to drain into the off-site detention area. The plat conforms to the PUD layout and design. The Planning Commission recommends approval.

11. Consider approval of the preliminary plat of the Orchards II Addition located south of Bradley and east of Center. (Applicant: JW. Burnley of Shared Funding LLC). Pgs. 125-127

The Planning Commission recommends approval of the preliminary plat of the Orchards II Addition with the requirement that the developer loop the water line back to Bradley and that better drainage information is provided to the City Engineer prior to construction. The construction plans have not been submitted, but will include the finish grades for the property. The water line revision has been submitted.

12. Consider approval of the final plat of Section I, Kickapoo and I-40 Commercial Center located at the Northwest Corner of Kickapoo and 45th Streets. (Applicant: State School Land Trust). Pgs. 128-130

The Planning Commission recommends approval of the Kickapoo & I-40 Commercial Center Addition, Section 1 with the requirement that the existing gas line be placed in a public utility easement, which can be reflected on the mylar copy. This is a single lot subdivision on 1.44 acres at the NW corner of 45th and Kickapoo. The driveways are located as far away from the signalized intersection as possible and will utilize joint access driveways. Seventy feet of right-of-way is being dedicated along Kickapoo to allow for the City and ODOT to widen Kickapoo to five lanes.


13. Consider an ordinance relating to possession or sale of drug related paraphernalia. Pgs. 131-133

14. Consider directing staff to proceed with the termination of lease at Belcher Tract, Lot 5 at Shawnee Lake. Pgs. 134-139

Staff has concluded that the lessee has violated his lake lot lease on several accounts. The adjoining residents have complained on numerous occasions of intimidation and harassment from the occupant. The dwelling has been enlarged without a permit and numerous electrical violations were observed by the building inspector. There have been so many violations over the last several years that the Community Development Department is recommending that this lease be terminated and asking the Commission to start the eviction procedure.
