SPECIAL CALLED SESSION
OCTOBER 22, 2007 AT 6:30 P.M.
The Board of City Commissioners of the City of Shawnee, County of Pottawatomie, State of Oklahoma, met in Special Called Session in the Commission Chambers at City Hall, 9th and Broadway, Shawnee, Oklahoma, Monday, October 22, 2007 at 6:30 p.m., pursuant to notice duly posted as prescribed by law. Mayor Mills presided and called the meeting to order. Upon roll call, the following members were in attendance.

Others in attendance were city staff, City Manager Jim Collard, Neva Treiber, Toni Gray, City Attorney John Canavan, Phyllis Loftis, Jim Bierd, John Krywicki. Amanda Gire, Shawnee News-Star, and Wayne Trotter, Shawnee Sun were also in attendance.
The Call for said meeting was entered upon the records by the City Clerk, said Call being as follows:
NOTICE OF A CALLED SPECIAL SESSION OF THE BOARD OF CITY COMMISSIONERS OF THE CITY OF SHAWNEE, OKLAHOMA
TO THE BOARD OF COMMISSIONERS OF THE CITY OF SHAWNEE, OKLAHOMA:
You and each of you are hereby notified that by virtue of a call issued by me on this 15th day of October, 2007, a Special Called Session will be held of the Board of Commissioners of the City of Shawnee Oklahoma in the Commission Chambers of City Hall, 16 W. 9th, Shawnee, Oklahoma at 6:30 p.m. on October 22, 2007, and you are hereby notified to be present at said meeting.
The purpose of said meeting will be to have a work session to discuss the drainage issues in the City of Shawnee, to consider accepting easement from the Citizens Potawatomi Nation at the northeast corner of Gordon Cooper Drive and Hardesty Road, confirm City Managers determination of emergency relating to the defects in the crane at the water treatment plant, and to hold an Executive Session to discuss the status of negotiations with the International Union of Police Associations Local #3 for FY 07-08 pursuant to O.S. §307(B)(2), and

CALL FOR SPECIAL SESSION OF THE BOARD OF COMMISSIONERS OF THE CITY OF SHAWNEE, OKLAHOMA TO BE HELD ON THE 22ND DAY OF OCTOBER, 2007 AT 6:30 O’CLOCK P.M. AGENDA ITEM NO. 1: Discuss and consider drainage issues in the City of Shawnee.
Mayor Mills opened the discussion by explaining to citizens in attendance that although this meeting was not a public hearing, he would allow brief citizen comments regarding their flooding issues. Due to the record rainfall received this year, many residents have experienced flooding problems. This special meeting was scheduled to provide the Commission with information regarding drainage and current city policy. The Commission will also consider what is the City’s responsibility regarding these drainage issues.
City Engineer John Krywicki gave a presentation showing each section of the City and highlighting areas where the City currently has drainage easements. Mr. Krywicki also provided an overlay of the Flood Plain map which showed how each section is affected during flooding situations.
Mr. Krywicki explained that water north of MacArthur Street flows northward to Rock Creek and water south of MacArthur Street flows south to the North Canadian River.
Mr. Krywicki’s presentation also included pictures of local residential flooding from June 26, 2007 and court rulings addressing liability issues regarding several Oklahoma cities.
As Mr. Krywicki explained, at the present time the City of Shawnee has very few drainage easements and does not have the right to enter upon private property to clean out creeks or ditches.
Commissioners and staff discussed the issue at length in an attempt to determine the City’s responsibility versus the homeowners. Funding and staffing issues were also discussed. It is the intention of the Commission to continue to examine this issue and to develop future policy standards.

AGENDA ITEM NO. 2: Consider accepting easement from the Citizens Potawatomi Nation at the northeast corner of Gordon Cooper Drive and Hardesty Road.
A motion was made by Commissioner Schrzan, seconded by Vice Mayor Peterson, to approve recommendation and accept easement from the Citizens Potawatomi Nation at the northeast corner of Gordon Cooper Drive and Hardesty Road. Motion carried 6-0.
AGENDA ITEM NO. 3: Confirm City Managers determination of emergency relating to the defects in the crane at the water treatment plant.
City Manager Jim Collard explained that he had declared an emergency in order to replace the crane at the Water Treatment Plant. The condition of the current crane was dangerous to city employees. Additionally, if the defective crane dropped a chlorine cylinder, public safety could also be affected.
Vice Mayor Peterson asked that a memo of explanation regarding this request be placed in the November 5, 2007 City Commission agenda.
A motion was made by Commissioner Stephens, seconded by Vice Mayor Peterson, to authorize purchase of crane at the water treatment plant. Motion carried 6-0.
AGENDA ITEM NO. 4: Consider an Executive Session to discuss the status of negotiations with the International Union of Police Associations Local #3 for FY 07-08 pursuant to 25 O.S. §307(B)(2).
A motion was made by Vice Mayor Peterson, seconded by Commissioner O’Neal, to go into Executive Session to discuss and consider the status of negotiations with the International Union of Police Associations Local #3 for FY 07-08 pursuant to 25 O.S. §307(B)(2). Motion carried 6-0.

CITY COMMISSION RECONVENED IN REGULAR SESSION AT 10:00 P.M. WITH ALL COMMISSIONERS PRESENT
AGENDA ITEM NO. 5: Consider matters discussed as a result of Executive Session in reference to the status of negotiations with the International Union of Police Associations Local #3 for FY 07-08 pursuant to 25 O.S. §307(B)(2).
The Commission received information only and no action was taken concerning the negotiations regarding contract with International Association of Police Associations at this time.
AGENDA ITEM NO. 6: Adjournment.
There being no further business to come before the meeting, a motion was made by Vice Mayor Peterson, seconded by Commissioner Stephens, that the meeting be adjourned.
Motion carried 7-0. (10:01 p.m.)
