BOARD OF CITY COMMISSIONERS PROCEEDINGS JULY 17, 2006 AT 5:30 P. M. The Board of City Commissioners of the City of Shawnee, County of Pottawatomie, State of Oklahoma, met in Regular Session in the Commission Chambers at City Hall, 9th and Broadway, Shawnee, Oklahoma, Monday, July 17, 2006 at 5:30 p.m., pursuant to notice duly posted as prescribed by law. Mayor Mills presided and called the meeting to order. Upon roll call, the following members were in attendance. COMMISSIONER O’NEAL NOW PRESENT AT 5:37 P.M. AGENDA ITEM NO. 1: Consider approval of Consent Agenda: a. Acknowledge staff will proceed in the instant meeting with the opening and consideration of bids as set forth in agenda item No. 17. b. Minutes from the July 3, 2006 meeting. c. Budget Amendment in Street Improvement Fund. d. Acknowledge the following reports and minutes: * Sales Tax Report through July, 2006 * License Payment Report for the month of June, 2006 * Project Payment Report for the month of June, 2006 * Shawnee Community Center report for the month of June, 2006 Sister Cities Council minutes from the June 13, 2006 meeting. Planning Commission minutes from the June 7, 2006 meeting. Shawnee Urban Renewal Authority minutes from the June 20, 2006 meeting. Civic and Cultural Development Authority minutes from the May 18, 2006 meeting. e. Approve Rebecca Cragin as authorized agent for the Oklahoma Municipal Retirement Fund, which includes the Defined Benefit Plan and the Defined Contribution Plan for City of Shawnee employees. f. Acknowledge Oklahoma Municipal Assurance Group 2006 Election of Trustees. g. Approve request of Carolyn Stringer to establish a limousine business in the City of Shawnee. h. Authorize staff to advertise for bids to upgrade lift station at Bryan Street and existing sludge lift station at the Water Treatment Plant. i. Authorize staff to advertise for bids for a new sanitary lift station at the Water Treatment Plant. j. Authorize staff to advertise for bids for new HVAC system at the Police Training Station. k. Mayor’s Appointment Sister Cities Council Appoint Pat Bolt to replace Sue Winterringer as Host Programs Chair to a term expiring 12/31/06. Before voting on the consent agenda, Commissioner Claybrook asked that Item No. 1(g) be removed for separate consideration. A motion was made by Commissioner Beck, seconded by Commissioner Schrzan, to approve Consent Agenda Item No. 1 (a-k), less (g). Motion carried 5-0. AYE: Beck, Schrzan, O’Neal, Mills, Claybrook NAY: None Under Item No. 1(g) Commissioner Claybrook had questions about the limousine service and its location in a residential district. Mr. Southard and the owner, Carolyn Stringer, addressed the questions to the Commission’s satisfaction. A motion was made by Commissioner Claybrook, seconded by Commissioner O’Neal, to approve the request from Carolyn Stringer to establish a limousine business in the city located at 1421 East Walnut. Motion carried 5-0. AYE: Claybrook, O’Neal, Mills, Beck, Schrzan NAY: None AGENDA ITEM NO. 2: Mayor’s Presentations: Mayor Mills presented a Certificate of Appreciation to Reverend Leroy Kerbo for his support at the meetings and his willingness to offer the invocation on a moments notice at the Commission meetings. Mayor Mills presented certificates to participants of Cops & Kids Program who participated in the first annual program supervised by Community Relations Officer Candie Swinney. AGENDA ITEM NO. 3: City Manager’s Presentation of Employee of the Month. (Charles Retherford, Animal Control Officer). This item was deferred to the next meeting. AGENDA ITEM NO. 4: Public hearing and consider an ordinance rezoning property located at the northwest corner of Bryan and Independence streets from R-1; Single Family Residential; C-1; Neighborhood Commercial and C-1P; Neighborhood Commercial with Conditional Use Permit to PUD; Planned Unit Development for use as a nursing home, assisted living center, senior living and complimentary light commercial. (Applicant: Fidler Properties, LLC) (Continued from 4/17/06, 5/15/06 and 6/19/06 meetings). Mayor Mills declared a public hearing in session to consider an ordinance to rezone property located at the northwest corner of Bryan and Independence for use as a nursing home, assisted living center, senior living and complimentary light commercial. Mayor Mills asked if anyone was in favor or in protest of the rezoning request. Community Development Director Mike Southard gave the staff report and it was noted the Planning Commission had recommended approval. There were no formal protests filed with the City Clerk. Mr. William Rice and Ms. Linda Prater, appeared on behalf of the application. No others appeared and the public hearing was closed. After due and careful consideration, Ordinance No. 2267NS was introduced and the title read aloud. Mayor Mills asked if any persons wished to appear in favor of or in protest of the rezoning request. The staff report was given and it was noted that the Planning Commission recommended approval and that no formal written protests had been filed. (Applicant: James McLeod) Mayor Mills declared a public hearing in session to consider an ordinance to rezone property located at 1221 N. McKinley for use as a mini storage facility. Mayor Mills asked if any persons wished to appear in favor of or in protest of the rezoning request. The city staff report was given by Community Development Director Mike Southard and he noted that the Planning Commission recommended approval. No other persons appeared and the public hearing was closed. After due and careful consideration, Ordinance No. 2269NS was introduced and the title read aloud. (Applicant: Jacklyn Vongsouvanh o/b/o Bill Townsend). Mayor Mills declared a public hearing in session to consider to rezone property located at 1416 N. Harrison to allow for the on-site consumption of alcoholic beverages in an eating establishment. Mayor Mills asked if any persons wished to appear in favor of or in protest of the rezoning request. The staff report was given and it was noted that the Planning Commission had recommended approval and no formal written protests had been filed. No others appeared and the public hearing was closed. (Applicant: Doyle Beck) Mayor Mills declared a public hearing in session to consider the rezoning of property located at 7311 N. Harrison for use as a mini storage facility. Mayor Mills asked if any persons wished to appear in favor of or in protest of the rezoning request. Community Development Director Mike Southard gave the staff report and he noted that the Planning Commission recommended approval. There were no formal written protests filed with the City Clerk. AGENDA ITEM NO. 9: Consider approval of final plat for Section 1 of Woodsong Gardens Addition located west of Bryan and north of 45th streets. (Applicant: Bryant Development Company). It was the Planning Commission and staff’s recommendation that the final plat for Section 1 of Woodsong Addition be approved. The report indicated that there would be 18 lots covering +/-5 acres. A motion was made by Commissioner Claybrook, seconded by Commissioner O’Neal, to approve of final plat for Section 1 of Woodsong Gardens Addition located west of Bryan and north of 45th streets. (Applicant: St. John Lutheran Church). The Planning Commission and staff recommended approval of the final plat for the St. John Addition at 3610 N. Union for a church to be built. The property is a single lot subdivision covering +/-3.6 acres. A motion was made by Commissioner Beck, seconded by Commissioner Schrzan, to approve of final plat of the St. John Addition located at 3610 N. Union. Motion carried 5-0. Saratoga for the period of July 17, 2006 through August 31, 2006. City Attorney John Canavan gave the staff report regarding Charter Communications request to sub-lease property at 707 W. Saratoga for a short term to allow time for the cable rights transfer to Allegiance communications company. A motion was made by Commissioner Claybrook, seconded by Commissioner Schrzan, to approve Charter Communications to sub-lease property located at 707 W. Saratoga for the period of July 17, 2006 through August 31, 2006. Motion carried 5-0. AYE: Claybrook, Schrzan, O’Neal, Mills, Beck NAY: None AGENDA ITEM NO. 12: Consider request from Joe McKimmey o/b/o the First Church of the Nazarene to release public nuisance liens on property located at 414 N. Market in the amount of $3,344.00. The Commission heard a request from Mr. Joe McKimmey, Attorney representing the First Church of the Nazarene, to release public nuisance liens on property located at 414 N. Market for the church’s use in which it had purchased the property at a 2006 tax sale. Upon discussion, it was the city attorney’s opinion that in this case the property was not for profit. A motion was made by Commissioner Beck, seconded by Commissioner Claybrook, to forgive and release the public nuisance liens held by the City on property located at 414 N. Market in the amount of $3,344.00 as requested by the First Church of the Nazarene. Motion carried 5-0. AYE: Beck, Claybrook, Schrzan, O’Neal, Mills NAY: None AGENDA ITEM NO. 13: Consider an ordinance amending the rates for collection and removal of garbage for single-family, two-family and multi-family dwellings in the City of Shawnee. At the June 19, 2006 meeting, the Commission approved staff’s recommendation to raise the garbage collection rates for residential by fifty cents from $9.50 to $10.00 per month. Ordinance No. 2272NS was introduced and the title read aloud. ORDINANCE NO. 2272NS ENTITLED “AN ORDINANCE RELATING TO THE CHARGE FOR COLLECTION AND REMOVAL OF GARBAGE FOR FAMILY DWELLINGS IN THE CITY OF SHAWNEE; AMENDING SUB-SECTION (a) SECTION 23-38, ARTICLE II, CHAPTER 23 OF THE CODE OF THE CITY OF SHAWNEE, OKLAHOMA; INCREASING THE RATES FOR SINGLE FAMILY, TWO FAMILY AND MULTI-FAMILY DWELLINGS FROM 9.50 PER MONTH TO $10.00 PER MONTH, AND PROVIDING FOR SEVERABILITY AND DECLARING AN EMERGENCY.” A motion was made by Commissioner Schrzan, seconded by Commissioner O’Neal, that the Title and Ordinance No. 2272NS, be approved. Thereupon Mayor Mills declared Ordinance No. 2272NS duly passed and adopted thirty (30) days from this date. AGENDA ITEM NO. 14: Consider an ordinance clarifying the hours for water usage for residential purposes under Levels 1, 2 and 3 of water rationing. Ordinance No. 2273NS was introduced and the title read aloud. ORDINANCE NO. 2273NS ENTITLED “AN ORDINANCE RELATING TO THE HOURS OF ALLOWED WATER USE FOR RESIDENTIAL PURPOSES UNDER LEVELS 1, 2 AND 3 OF WATER RATIONING; AMENDING PARTS (i), (ii) AND (iii) OF SUB-SECTION (b)(1) OF SECTION 26-67, DIVISION 1, ARTICLE III OF CHAPTER 26 OF THE CODE OF THE CITY OF SHAWNEE, OKLAHOMA CLARIFYING THE HOURS OF ALLOWED WATER USE UNDER RATIONING LEVELS 1, 2 AND 3; PROVIDING FOR SEVERABILITY AND DECLARING AN EMERGENCY.” A motion was made by Commissioner Beck, seconded by Commissioner Schrzan, that the Title and Sections 1-4 Amendatory, be approved. AGENDA ITEM NO. 15: Consider authorizing staff to negotiate a contract with Southwest Chemical for chlorine dioxide. The staff report was given by Utility Director Afsaneh Jabbar regarding her request for authorization to negotiate a contract with the supplier for chlorine dioxide in order to allow the staff to test the viability of using chlorine dioxide for a pre-oxidant in pre-treatment of water. A motion was made by Commissioner Claybrook, seconded by Commissioner Schrzan, to authorize staff to negotiate a contract with Southwest Chemical for chlorine dioxide. Motion carried 5-0. AYE: Claybrook, Schrzan, O’Neal, Mills, Beck NAY: None AGENDA ITEM NO. 16: Consider a project agreement with Oklahoma Baptist University for construction of University Drive and relocation of city water main. City Engineer John Krywicki gave the staff report updating the Commission of its approval for the City to participate in the construction of University Drive improvements for relocation of 6-inch water main. The agreement stated that OBU be permitted to engineer and let a contract to construct University Drive east of Airport Drive as a curb and gutter improvement along with associated storm sewer improvements and water line relocation, and OBU is to be reimbursed by the City for a portion of the project costs. The city engineer noted that the City’s portion of the cost was not to exceed $110,000. A motion was made by Commissioner Schrzan, seconded by Commissioner Claybrook, to approve the project agreement with Oklahoma Baptist University for construction of University Drive and relocation of city water main. AGENDA ITEM NO. 19: Administrative Reports Under Administrative Reports, Interim Police Chief Wayne Crall reported that he had been notified by the U.S. Postmaster regarding animals interfering with mail delivery at residences and carriers had been injured on the job due to dog attacks. He advised that police would patrol the problem areas and approach this situation as a public safety issue. The chief also reported that in a forged check case that had been worked from five weeks ago, the person was identified and that person agreed assist the undercover drug division to catch other offenders. Assistant Airport Manager Jerry Sharp gave updates on the fuel truck being delivered from Birmingham, Alabama and at the end of July or early August the airport will begin operations of selling fuel. Community Development Director Mike Southard reported that staff would continue negotiating with the State Land Commission for property for the sports complex; and a Dunbar Heights neighborhood strategic meeting would be held tomorrow at 6:00 p.m. in the Family Life Center at Immanuel Baptist Church. AGENDA ITEM NO. 21: Commissioners Comments Under Commissioners Comments, Mayor Mills announced that tomorrow at 7:00 p.m. would be held the political forum in the Commission Chambers at City Hall for the Ward 1 and 6 city commission seats and the democratic State Representative District 26. Four candidates for the city commissioner positions and two candidates for the state representative seat will speak in separate forums. In response to the letter from the Postmaster regarding dog attacks on mail carriers, Commissioner Beck commented that the city may have a serious animal control problem and possibly understaffed. He requested staff to conduct a survey of other cities similar to Shawnee and report their findings. Commissioner Beck praised Police Officer Alsip for handling in a professional manner a situation involving a stolen car. Commissioner Schrzan announced that his wife’s uncle will be recognized on July 22 as “Carl Hubble Day” at the Bricktown ball park.
