The Board of City Commissioners of the City of Shawnee, County of Pottawatomie, State of Oklahoma, met in Regular Session in the Commission Chambers at City Hall, 9th and Broadway, Shawnee, Oklahoma, Monday, April 19, 2004 at 7:00 p.m., pursuant to notice duly posted as prescribed by law. Mayor Harden issued the following proclamation: “Equal Pay Day” April 20, 2004 (accepted by Diane Beesley, BPW Cartwright Hi-Noon) AGENDA ITEM NO. 3: Public hearing and consider an ordinance rezoning property located at 2229 W. Benedict from A-1; Agricultural District to C-3P; Automotive and Commercial Recreational District with Conditional Use Permit for the sale of beer and alcohol for on-premise consumption. (Applicant: Terry Thornton d/b/a Long Ears Bar and Grill) (Application to rezone was withdrawn by applicant). Mayor Harden declared a public hearing in session to consider an ordinance to rezone property located at 2229 W. Benedict for the sale of beer and alcohol for on-premises consumption. A motion was made by Vice Mayor Downing, seconded by Commissioner Weaver, that this item be withdrawn from the agenda per the applicant’s request. Motion carried. (Applicant: David Petricek) Mayor Harden declared a public hearing in session to consider an ordinance to rezone property located at 32703 Clearpond Road to allow moving a mobile home on the property. It was noted the Planning Commission had recommended approval of the rezoning and there were no formal protests filed with the City Clerk. Mayor Harden asked if any persons wished to appear in favor of or in protest of the rezoning. No persons appeared and the public hearing was closed. After due and careful consideration, Ordinance No. 2148NS was introduced and the title read aloud. Ordinance No. 2148NS entitled “An ordinance concerning the zoning classification of the following described property located within the corporate limits of the City of Shawnee, Pottawatomie County, Oklahoma, to-wit: All that part of the Northeast Quarter (NE/4) of Section 27, Township 10 North, Range 2 East of the Indian Meridian, Pottawatomie County, Oklahoma, lying east of a line beginning at a point 1323 feet east of the Northwest Corner of said Northeast Quarter (NE/4); thence south 990 feet; thence east 330 feet; thence south 660 feet; thence west 990 feet; thence south to the south line of said quarter section rezoning said property from A-1; Agricultural District to A-1P; Agricultural District with conditional use permit and amending the official zoning map of the City of Shawnee accordingly.” A motion was made by Commissioner Weaver, seconded by Commissioner Peterson, that the Title and Section 1 be approved. (Applicant: Ralph & Steve McElmurry) Mayor Harden declared a public hearing in session to consider an ordinance to rezone property located at 42404 East Westech Road for the purpose of rural residential development. It was noted the Planning Commission had recommended approval of the rezoning and there were no formal protests filed with the City Clerk. Mayor Harden asked if any persons wished to appear in favor of or in protest of the rezoning. No persons appeared and the public hearing was closed. After due and careful consideration, Ordinance No. 2149NS was introduced and the title read aloud. Harrison from C-3; Automotive and Commercial Recreation District to C-3P; Automotive and Commercial Recreation District with Conditional Use Permit for the sale of beer and alcohol for on-premise consumption. (Applicant: Jalal Rahseparian d/b/a City Lights) Mayor Harden declared a public hearing in session to consider an ordinance to rezone property located 4900 North Harrison for the sale of beer and alcohol for on-premises consumption (City Lights). It was noted the Planning Commission had recommended approval of the rezoning and no formal protests were filed with the City Clerk. Mayor Harden asked if any persons wished to appear in favor of or in protest of the rezoning. No persons appeared and the public hearing was closed. After due and careful consideration, Ordinance No. 2150NS was introduced and the title read aloud. AGENDA ITEM NO. 7: Public hearing and consider an ordinance rezoning property located at 31820 Ingram Road from A-1; Agricultural District to A-1P; Agricultural District with Conditional Use Permit to allow moving a mobile home on the property. (Applicant: David & Melissa Juber). Mayor Harden declared a public hearing in session to consider an ordinance to rezone property located 31820 Ingram Road to allow a mobile home on the property. It was noted the Planning Commission had recommended approval of the rezoning and there were no formal protests filed with the City Clerk. Mayor Harden asked if any persons wished to appear in favor of or in protest of the rezoning. No persons appeared and the public hearing was closed. After due and careful consideration, Ordinance No. 2151NS was introduced and the title read aloud. Ordinance No. 2151NS entitled “An ordinance concerning the zoning classification of the following described property located within the corporate limits of the City of Shawnee, Pottawatomie County, Oklahoma, to-wit: A tract of land in the Southwest Quarter of the Northeast Quarter (SW/4 NE/4) of Section 16, Township 10 North, Range 2 east of the Indian Meridian, Pottawatomie County, Oklahoma, described as beginning 329.40 feet S00°04’03”W of the northeast corner of said Southwest Quarter of the Northeast Quarter (SW/4 NE/4); thence N89°24’42”W a distance of 697.34 feet’ thence S00°04’04”W a distance of 329.49 feet; thence S89°25’14”E a distance of 697.34 feet; thence N00°04’03”E a distance of 329.38 feet to the point of beginning and rezoning said property from A-1; Agricultural District to A-1P; Agricultural District with conditional use permit and amending the official zoning map of the City of Shawnee accordingly.” A motion was made by Commissioner Peterson, seconded by Commissioner Harrod, that the Title and Section 1 be approved. AGENDA ITEM NO. 8: Consider an ordinance de-annexing property located at the corner of Benson Park Road and Harrison. (Applicant: Rodney & Julie McPhetridge) Community Development Director Mike Southard reported that the Annexation Committee recommended de-annexing the property located on the Northeast corner of Benson Park and Harrison. This tract is the only property along Benson Park that is in the city limits and is served by few city services. It is served by the rural water district. Ordinance No. 2152 was introduced and the title read aloud. Ordinance No. 2152NS entitled “An ordinance de-annexing certain territory and property from the present city limits of the City of Shawnee, Oklahoma, pursuant to Title 11 of the Oklahoma Statutes; describing said property; repealing all portions of ordinances in conflict herewith; and declaring an emergency.” A motion was made by Vice Mayor Downing, seconded by Commissioner Weaver, that the Title and Sections 1 and 2 be approved. Motion carried. AGENDA ITEM NO. 9: Consider request of Travis Guess for extension of time to remodel property located at 147 S. Draper. Community Development Director Mike Southard reported that in February of 2003, the Commission granted a 90-day extension to Mr. Guess to remodel the property located at 147 South Draper. Since that time, little work had been done and the progression has been extremely slow since the nuisance began in March 2001. Appearing before the Commission was Mr. Sherman Murray, attorney representing First United Bank, in which the bank has interest due to a mortgage being paid on the property. Next, Mr. Travis Guess, property owner, appeared before the Commission to state his reasons for not getting the house rehabbed in a timely manner. In discussion, there were several conditions that Mr. Guess would be required to complete in the time allowed by the Commission. A motion was made by Commissioner Harrod, seconded by Vice Mayor Downing, to grant another extension to Mr. Guess for six (6) months with conditions that the driveway, sewer line, plumbing, and façade metal work on the house must be completed. Motion carried. AYE: Harrod, Downing, Claybrook, Harden, Peterson NAY: Weaver AGENDA ITEM NO. 10: Consider appeal of Jeanne Haley of Administrative Hearing Officer’s order regarding property located at 802 S. Beard. City staff member Mike Southard reported that on February 12, 2004, Brewer & Son was ordered to obtain a building permit within 30 days on property located 802 South Beard and for all renovations to be completed by May 6, 2004. Garth Nixon represented the owner Jeanne Haley, and the Commission granted a 45-day continuance to Ms. Haley so that she could obtain a clear title after paying the back taxes on the property. Since that time, the property has continued to deteriorate and has become a hazard to the public. Appearing was Ms. Jeanne Haley informing the Commission that she had paid the back taxes and on April 6th obtained clear title to the property. She stated that she had started clearing the property and asked for time to get a building permit to start working on the building. A motion was made by Commissioner Harrod, seconded by Commissioner Claybrook, to grant Jeanne Haley a 45-day extension to clean up the property of trash and debris and start the process with city inspector to determine the requirements for renovation of the structure. Motion carried. AYE: Harrod, Claybrook, Harden, Weaver, Peterson, Downing NAY: None AGENDA ITEM NO. 11: Consider request of Ron and Ruth Crews to release public nuisance liens on property located at 1222 N. Market. ($3,535.00) Mr. Ron Crews, 1224 North Market, appeared before the Commission on June 16, 2003 to request approval to release the public nuisance liens on property located at 1222 North Market in the amount of $3,535.00. Mr. Crews informed the Commission at that time, that he had been mowing the property for several years and would like to purchase the property to maintain beautification of the neighborhood. City Planning Director Mike Southard presented the staff report noting that proper steps had been taken to demolish the burned out structure and the City’s contractor had mowed the property since that time. It was City Attorney John Canavan’s legal opinion that the properties are not released for private use but for public or non-profit organization purposes. A motion was then made by Commissioner Weaver, seconded by Commissioner Peterson, to deny the request of Ron and Ruth Crews to release public nuisance liens on property located at 1222 North Market. Motion carried. AYE: Weaver, Peterson, Downing, Claybrook, Harrod, Harden NAY: None AGENDA ITEM NO. 12: Consider recommendations from Community Service Contracts Review Committee regarding renewal of contracts with the following for fiscal year 2004-2005: It was noted that due to the decline in the City’s budget, the following contracts had been reduced by ten percent (10%), except the new contract with the District Attorney’s Office and the COCAA/Central Oklahoma Transit System, which remained the same since it has been operating under budget. a. District Attorney’s Drug Task Force A motion was made by Commissioner Claybrook, seconded by Commissioner Weaver, to approve the recommendation to renew the contract between the City of Shawnee and the District Attorney’s Drug Task Force for fiscal year 2004-2005 in the amount of $18,000.00. Motion carried. AYE: Claybrook, Weaver, Peterson, Downing, Harrod, Harden NAY: None b. District Attorney Certified Forensic Interviewer (new contract) A motion was made by Vice Mayor Downing, seconded by Commissioner Weaver, to approve the recommendation for a new contract between the City of Shawnee and the District Attorney’s Office of the Twenty-Third Judicial District of the State of Oklahoma for fiscal year 2004-2005 in the amount of $10,000.00 for assistance in hiring a Certified Forensic Interviewer. Motion carried. AYE: Downing, Weaver, Peterson, Claybrook, Harden NAY: Harrod c. Central Oklahoma Community Action Agency for operation of Community Center and Municipal Auditorium A motion was made by Commissioner Weaver, seconded by Commissioner Claybrook, to approve the recommendation to renew the contract between the City of Shawnee and the Central Oklahoma Community Action Agency for the operation of the Community Center and Municipal Auditorium for fiscal year 2004-2005 in the amount of $43,200.00. Motion carried. AYE: Weaver, Claybrook, Harrod, Harden, Peterson, Downing NAY: None d. Central Oklahoma Community Action Agency/Central Oklahoma Transit It was noted that funding would come from the General Fund of $25,000 and Economic Development of $25,000. A motion was made by Commissioner Claybrook, seconded by Vice Mayor Downing, to approve the recommendation to renew the contract between the City of Shawnee and the Central Oklahoma Community Action Agency/Central Oklahoma Transit for fiscal year 2004-2005 in the amount of $50,000.00. Motion carried. AYE: Claybrook, Downing, Harrod, Harden, Weaver, Peterson NAY: None e. Senior Citizens of Shawnee, Inc. A motion was made by Commissioner Claybrook, seconded by Commissioner Harrod, to approve the recommendation to renew the contract between the City of Shawnee and the Senior Citizens of Shawnee, Inc. for fiscal year 2004-2005 in the amount of $38,700.00. Motion carried. AYE: Claybrook, Harrod, Harden, Weaver, Downing NAY: None ABSTAIN: Peterson f. Downtown Shawnee, Inc. A motion was made by Commissioner Harrod, seconded by Commissioner Claybrook, to approve the recommendation to renew the contract between the City of Shawnee and Downtown Shawnee, Inc. for fiscal year 2004-2005 in the amount of $38,250.00. Motion carried. AYE: Harrod, Claybrook, Harden, Weaver, Peterson, Downing NAY: None AGENDA ITEM NO. 13: Consider appointing the following advisory committee to review past economic development expenditures and make recommendations for future expenditures and direction of funds: Chris Harden, Terry Compton, Chuck Mills and David Hadley. A motion was made by Vice Mayor Downing, seconded by Commissioner Weaver, to appoint Chris Harden, Terry Compton, Chuck Mills and David Hadley to an advisory committee to review past economic development expenditures and make recommendations for future expenditures and direction of funds. Motion carried. AYE: Downing, Weaver, Peterson, Claybrook, Harrod, Harden NAY: None AGENDA ITEM NO. 14: Consider an ordinance raising plumbing contractor registration fees, changing the registration date and repealing fees for journeyman/apprentice plumbers and repealing requirement for city insurance policy and labeling identification number on vehicle. City Clerk Diana Hallock advised the Commission that the following ordinance and the next two agenda items was to bring the current ordinance up to code in accordance with the latest state statutes. She requested the Commission not to adopt the “emergency clause” to allow staff time to notify the contractors. Ordinance No. 2153NS was introduced and the title read aloud. Ordinance No. 2153NS entitled “An ordinance relating to registration of plumbers in the City of Shawnee; amending Sections 7-396, 7-397 and 7-398, Division 2, Article VII, of Chapter 7 of the Code of the City of Shawnee; omitting the requirement for insurance policy for the City, raising fees for plumbing contractors, removing fees for journeyman plumbers and apprentice plumbers; and changing the expiration date on certificates of registrations; repealing Sections 7-399 and 7-400, Division 2, Article VII of Chapter 7 of the Code of the City of Shawnee in their entirety; providing for severability and declaring an emergency.” A motion was made by Vice Mayor Downing, seconded by Commissioner Claybrook, that the Title and Sections 1-6, be approved. AGENDA ITEM NO. 15: Consider an ordinance raising mechanical contractor registration fees, changing the registration date and repealing fees for journeyman/apprentice mechanical contractors and repealing requirement for labeling identification number on vehicle. Ordinance No. 2154NS was introduced and the title read aloud. Ordinance No. 2154NS entitled “An ordinance relating to mechanical licensing; amending Section 7-302, Division 1, Article VI, of Chapter 7 of the Code of the City of Shawnee; raising contractor fees and amending license expiration dates; repealing Section 7-303 in its entirety; providing for severability and declaring an emergency.” A motion was made by Commissioner Peterson, seconded by Vice Mayor Downing, that the Title and Sections 1-3, be approved. AGENDA ITEM NO. 16: Consider an ordinance raising electrical contractor registration fees, changing the registration date and repealing fees for journeyman/apprentice electricians and repealing requirement for labeling identification number on vehicle. Ordinance No. 2155NS was introduced and the title read aloud. Ordinance No. 2155NS entitled “An ordinance relating to electricians in the City of Shawnee; amending Sections7-126 and 7-129, Division 3, Article III, Chapter 7 of the Code of the City of Shawnee; raising fees for electrical contractors, and omitting registration of journeyman electricians and apprentices; deleting Section 7-130, Division 3, Article III, Chapter 7 of the Code of the City of Shawnee in its entirety; providing for severability and declaring an emergency.” A motion was made by Vice Mayor Downing, seconded by Commissioner Peterson, that the Title and Sections 1-5, be approved. AGENDA ITEM NO. 17: Consider awarding bid for 24” Water Main Extension. A motion was made by Commissioner Claybrook, seconded by Commissioner Harrod, to accept staff’s recommendation to award the bid for the 24” water main extension to Jim Mayes Company, Norman, Oklahoma, in the amount of $432,846.50 as the lowest as best bid. Motion carried. AYE: Claybrook, Harrod, Harden, Weaver, Peterson, Downing NAY: None AGENDA ITEM NO. 18: New Business (Any matter not known about or which could not have been reasonably foreseen prior to the time of posting agenda) Under New Business, Interim City Manager Terry Compton announced that he was putting the public on notice effective immediately the City of Shawnee was under water rationing at Level 3. The Water Conservation Plan at Level 3 states: “When the lake level reaches an elevation 1,068 feet and the average daily usage exceeds 5,000,000 gallons for seven days: Residential, other than household purposes: Water usage restricted to 12:01 A.M. to 1:00 P.M. on the odd-even system with odd-numbered houses utilizing water on Tuesdays and even-numbered houses utilizing water on Thursdays during the above hours.” He advised the Commission that staff would closely monitor the situation. The lake level is currently between 1,066 and 1,067 feet. AGENDA ITEM NO. 19: Administrative Reports. There were no Administrative Reports. AGENDA ITEM NO. 20: Citizens Participation (A five minute limit per person) (A fifteen-minute limit per topic) Under Citizens Participation, a local citizen appeared before the Commission to request the “no smoking within 25 feet of any public building” be enforced at the public library. AGENDA ITEM NO. 21: Commissioners Comments. Under Commissioners Comments, Commissioner Claybrook voiced concern about the hydrant flushing while under the water rationing. Chief Jerrry Bower responded that he would put on hold the flushing and testing. He also noted that this was an evaluation year for insurance purposes, but would ask the State to delay to the end of the year. Mayor Harden urged staff not to forget Mr. Tom Smith’s request for a Veteran’s park. AGENDA ITEM NO. 22: Adjournment. There being no further business to come before the meeting, a motion was made by Vice Mayor Downing, seconded by Commissioner Claybrook, that the meeting be adjourned. Motion carried.
