PLANNING COMMISSION MINUTES
DATE: August 3, 2011

The Planning Commission of the City of Shawnee, County of Pottawatomie, State of Oklahoma, met in Commission Chambers, at City Hall, 9th and Broadway, on Wednesday, August 3, 2011 at 1:30 p.m., pursuant to notice duly posted as prescribed by law. Justin Erickson, Planning Director for the City of Shawnee, presented the staff reports. Staff reports are available upon request.

AGENDA ITEM NO. 1: Roll Call

Upon roll call the following members were present:

Taylor Prince, Kirk Hoster, Brad Carter, Shawna Turner,
Carl Holt, Chris Silvia, Ben Salter

A quorum was declared present and the meeting was called to order.


AGENDA ITEM NO. 2: Approval of the minutes from the July 6, 2011 Planning Commission Meeting.

Shawna Turner for a motion, Commissioner Holt made a motion seconded by Commissioner Silvia to approve the July 6, 2011 minutes,

Motion carried:
AYE: Holt, Silvia, Salter, Prince, Carter, Turner
NAY: None
ABSTAIN: Hoster

AGENDA ITEM NO. 3: Case # P09-11 – Consideration of approval to rezone property located at 606 E. Seymour from R-1; Single Family Residential to R-3; Multi-Family Dwelling. Applicant: Abner Monterroso.

Shawna Turner asked for the staff report. Justin Erickson presented the staff report.

After presenting the staffreport, Mr. Erickson stated that if the Planning Commission recommends approval to rezone to R-3, that the decision be based on the following findings:





1. The area of the subject site is too small to be intensively developed; but at the same time, the lot area is too large to be devoted exclusively to a single residence.
2. Development of a triplex on the subject site is not inconsistent with the Shawnee Comprehensive Plan.
3. The proposed dwelling units are consistent in size with neighboring structures.
4. Rezoning of the subject site to R-3 will not be detrimental to public health, safety or welfare.
5. Rezoning of the subject site will not negatively impact adjacent neighbors or disrupt the neighborhood or community dynamic.

Shawna Turner asked if anyone was for the proposal. Abner Monterosso came forward for the proposal and answered questions from the Commission.

Shawna Turner asked if anyone was against the proposal. No one came forward.

Shawna Turner asked for a motion, Commissioner Prince made a motion, seconded by Commissioner Silvia to approve rezoning 606 E. Seymour to R-3 based on the 5 findings as outlined by staff and an added 6th stating the 5x 54 designated green area to be curbed.

Motion carried:
AYE: Prince, Silvia, Hoster, Carter, Turner, Holt, Salter
NAY: None
ABSTAIN: None

AGENDA ITEM NO. 4: Planning Director’s report.

Justin Erickson reported there were 7 new home permits and 1 multi-family permit with 20 units issued in July.
