BOARD OF CITY COMMISSIONERS
CITY OF SHAWNEE
SPECIAL CALLED SESSION
APRIL 11, 2011

The Board of City Commissioners met in Special Called Session at the Heart of Oklahoma Exposition Center, Highway 177 and Independence Street, Shawnee, Oklahoma, Monday, April 11, 2011 at 9:00 a.m., pursuant to notice duly posted as prescribed by law. Mayor Peterson presided and called the meeting to order. Upon roll call, the following members were in attendance.

Others in attendance were City Manager Brian McDougal, City Clerk Phyllis Loftis, Finance Director/Treasurer Cynthia Sementelli, Stephen Nolen, Nancy Keith, Steve Wallace, Tim Burg, Justin Erickson, Tracy McDaniel, Mary Ann Karns, Casey Bell, Mike Adcock, Daniel Shaughnessy and Jerry Bayliss. The media was represented by Robbie Short, Shawnee News Star and Wayne Trotter, Countywide News.

The Call for said meeting was entered upon the records by the City Clerk, said Call being as follows:

NOTICE OF A CALLED SPECIAL SESSION OF THE BOARD OF CITY COMMISSIONERS OF THE CITY OF SHAWNEE, OKLAHOMA

TO THE CITY COMMISSION OF THE CITY OF SHAWNEE, OKLAHOMA:

You and each of you are hereby notified that by virtue of a call issued by me on this 4th day of April, 2011, a Special Called Session will be held of the Board of Commissioners of the City of Shawnee, Oklahoma at the Heart of Oklahoma Exposition Center, Highway 177 and Independence Street, Shawnee, Oklahoma at 9:00 a.m. on April 11, 2011, and you are hereby notified to be present at said meeting.
The purpose of said meeting will be for consideration and possible action to enter into Executive Session for the purpose of discussing the possible hiring of Mary Ann Karns as the full time City Attorney as authorized by 25 O.S. 307(B)(1); consideration and possible action to approve the hiring of Mary Ann Karns as the full time City Attorney and to authorize the Mayor to enter into a written Employment Agreement with Ms. Karns; and discuss and consider the City’s Capital Improvement Projects and their financing options.

CALL FOR SPECIAL SESSION OF THE SHAWNEE BOARD OF CITY COMMISSIONERS OF THE CITY OF SHAWNEE, OKLAHOMA TO BE HELD ON THE 11TH DAY OF APRIL, 2011 AT 9:00 O’CLOCK A.M. AT THE HEART OF OKLAHOMA EXPOSITION CENTER, HIGHWAY 177 AND INDEPENDENCE STREET, SHAWNEE, OKLAHOMA. THE PURPOSE OF SAID MEETING WILL BE FOR CONSIDERATION AND POSSIBLE ACTION TO ENTER INTO EXECUTIVE SESSION FOR THE PURPOSE OF DISCUSSING THE POSSIBLE HIRING OF MARY ANN KARNS AS THE FULL TIME CITY ATTORNEY AS AUTHORIZED BY 25 O.S. 307(B)(1); CONSIDERATION AND POSSIBLE ACTION TO APPROVE THE HIRING OF MARY ANN KARNS AS THE FULL TIME CITY ATTORNEY AND TO AUTHORIZE THE MAYOR TO ENTER INTO A WRITTEN EMPLOYMENT AGREEMENT WITH MS. By virtue of the authority vested in me by Section 4, Article IV of the Charter of the City of Shawnee, Oklahoma, a Special Session of the Board of City Commissioners of the City of Shawnee, Oklahoma is hereby called to meet at the Heart of Oklahoma Exposition Center, Highway 177 and Independence Street, Shawnee, Oklahoma at 9:00 a.m. on April 11, 2011 for consideration and possible action to enter into Executive Session for the purpose of discussing the possible hiring of Mary Ann Karns as the full time City Attorney as authorized by 25 O.S. 307(B)(1); consideration and possible action to approve the hiring of Mary Ann Karns as the full time City Attorney and to authorize the Mayor to enter into a written Employment Agreement with Ms. Karns; and discuss and consider the City’s Capital Improvement Projects and their financing options.

DECLARATION OF A QUORUM

Roll was called with all Commissioners present and a quorum was declared.
AGENDA ITEM NO. 1: CONSIDERATION AND POSSIBLE ACTION TO ENTER INTO EXECUTIVE SESSION FOR THE PURPOSE OF DISCUSSING THE POSSIBLE HIRING OF MARY ANN KARNS AS THE FULL TIME CITY ATTORNEY AS AUTHORIZED BY 25 O.S. 307(B)(1).
A motion was made by Vice Mayor Sims, and seconded by Commissioner Stephens to enter into executive session. Motion carried 7-0.
AYE: Sims, Stephens, Harrod, Peterson, Collier, Winterringer, Smith

Commission enters into Executive Session at 9:16 a.m.
AGENDA ITEM NO. 2: CONSIDERATION AND POSSIBLE ACTION TO APPROVE THE HIRING OF MARY ANN KARNS AS THE FULL TIME CITY ATTORNEY AND TO AUTHORIZE THE MAYOR TO ENTER INTO A WRITTEN EMPLOYMENT AGREEMENT WITH MS. KARNS.
Commissioners return from Executive Session at 9:46 a.m. with all Commissioners present.
A motion was made by Vice Mayor Sims, seconded by Commissioner Stephens to approve the hiring of Mary Ann Karns as the full-time
City Attorney and to authorize the Mayor to enter into a written employment agreement with Ms. Karns, subject to the employment requirements of the City of Shawnee. Employment of Ms. Karns is to begin immediately. Motion carried 7-0.

AGENDA ITEM NO. 3: Discuss and consider the City’s Capital Improvement Projects and their financing options.

Mayor Peterson began the discussion by stating that the Capital Improvement List approved by the City Commission was the result of two years of defining and prioritizing City projects. The purpose of today’s meeting is to narrow the list to key projects, how to proceed in moving forward with the projects and to consider financing options.

The four major categories being considered are projects that fall under Recreation, Streets, Expo and Public Safety.

The discussion among Commissioners included whether to construct the Regional Park in phases or build the entire project at once; the parking lot at the Expo Center; the continuation of the Kickapoo Street paving project to the south to Farrall and north toward the Regional Park

Financial options were discussed, including ˝ cent sales tax increase and/or General Obligation bonds, use of the current third penny and the City’s ability to finance projects within their existing budget.

The following citizens spoke to the Commission sharing their viewpoints and opinions: Mike Adcock, Steve Wallace, Casey Bell, SEDF Director Tim Burg and Daniel Shaughnessy.

At the conclusion of the discussion, Vice Mayor Sims made a motion, seconded by Commissioner Stephens, to appoint Vice Mayor Sims, Commissioner Harrod and Commissioner Stephens to a sub-committee that will meet to discuss the projects and financing options and report back to the full Commission with their recommendations.

AGENDA ITEM NO. 4: ADJOURNMENT

There being no further business to come before the meeting, a motion was made by Commissioner Harrod , seconded by Commissioner Winterringer, that the meeting be adjourned. Motion carried 7-0. (12:09 p.m..)
