The Zoning Board of Adjustment met at a scheduled meeting on Thursday, September 18, 2008 at 2:30 p.m. in the Commission Chambers at City Hall, Shawnee, Oklahoma, Pottawatomie County, pursuant to notice duly posted as prescribed by law.

AGENDA ITEM NO. 1: Roll Call

Upon roll call the following members were present:
Chairman

Paul Bass
Dennis Morris Bob East

ABSENT: None
Note: New Commissioners Toby Blaylock & Joe Freeman were also present.



AGENDA ITEM NO. 2: Approval of the July 17, 2008 Zoning Board of Adjustment meeting minutes.

Paul Bass asked for a motion, Bob East made a motion, seconded by Dennis Morris to approve the minutes from the July 17, 2008 meeting.

Motion carried:
AYE: East, Morris and Bass
NAY: None
ABSTAIN: None



AGENDA ITEM NO. 3: Swear in Toby Blaylock and Joe Freeman to the Zoning Board of Adjustment.

Toby Blaylock and Joe Freeman were sworn in to the Zoning Board of Adjustment.



Bill Wiedower, Bill Thurman and Donald Pyeatt were present for the meeting

AGENDA ITEM NO. 4: Case #Z08-08 Location of property: 301 S. Kennedy – Applicant: Bill Wiedower obo Faith 7 Housing Inc. A Public Hearing for consideration of granting a variance to the Zoning Code Article V. Multi-Family Residential District (R-3) Section 505.8 Fencing which requires fencing or sight proof screening of side and rear lot lines of R-3 zoned property .


Paul Bass asked for the staff report. Justin Erickson, Planning Director summarized the staff report. Mr. Erickson stated this site has unique conditions including the use of the nearby Faith 7 Activity Center and the planned future development of the area between the apartments under construction and the Activity Center. Screening would serve no useful purpose in this area, as it would essentially amount to screening one area site from another and would likely be removed during construction of the next phase. Typically screening would be from adjacent properties, this property is owned by the same entity.

Staff recommended approving the requested to eliminate the side yard screening requirement.

Bill Wiedower came forward and stated Mr. Erickson did and excellent job of presenting this case. Mr. Wiedower answered questions from the Board.

Paul Bass asked for a motion, Bob East made a motion, seconded by Dennis Morris to approve the variance to eliminate the side yard screening requirement.
Motion carried:
AYE: East, Morris, Blaylock and Bass
NAY: None
ABSTAIN: Freeman

AGENDA ITEM NO 6: Adjournment

Paul Bass asked for a motion, Joe Freeman made a motion, seconded by Toby Blaylock to adjourn.
Motion carried:
AYE: Freeman, Blaylock, East, Morris and Bass
NAY: None
ABSTAIN: None


Thereupon, this shall be a legal decision of the Zoning Board of Adjustment by the authority and power vested by Ordinance.
