BOARD OF CITY COMMISSIONERS PROCEEDINGS
SPECIAL CALLED SESSION
OCTOBER 30, 2006 AT 5:30 P.M.
The Board of City Commissioners of the City of Shawnee, County of Pottawatomie, State of Oklahoma, met in Special Called Session in the Commission Chambers at City Hall, 9th and Broadway, Shawnee, Oklahoma, Monday, October 30, 2006 at 5:30 p.m., pursuant to notice duly posted as prescribed by law. Mayor Mills presided and called the meeting to order. Upon roll call, the following members were in attendance.

Others in attendance were city staff, citizens of the community, Wayne Trotter, Editor of the Shawnee Sun, and Courtney Bryce, Shawnee News Star Reporter.
The Call for said meeting was entered upon the records by the City Clerk, said Call being as follows:
CALL FOR SPECIAL SESSION OF THE BOARD OF COMMISSIONERS OF THE CITY OF SHAWNEE, OKLAHOMA TO BE HELD ON THE 30TH DAY OF OCTOBER, 2006 AT 5:30 CLOCK P.M. AT THE SHAWNEE CITY HALL COMMISSION CHAMBERS, 16 WEST 9TH, SHAWNEE, OKLAHOMA FOR THE PURPOSES OF A PUBLIC FORUM TO DISCUSS SEPTIC SYSTEM ISSUES AND PROPOSED SEPTIC SYSTEM REGULATIONS WITHIN THE CITY OF SHAWNEE. .
By virtue of the authority vested in me by Section 4, Article IV of the Charter of the City of Shawnee, Oklahoma, Special Session of the Board of Commissioners of the City of Shawnee, Oklahoma is hereby called to meet at the Shawnee City Hall Commission Chambers, 16 West 9th, Shawnee, Oklahoma at 5:30 p.m. on October 30, 2006 for the purpose of a public forum to discuss septic system issues and proposed septic system regulations within the City of Shawnee.

TO THE BOARD OF COMMISSIONERS OF THE CITY OF SHAWNEE, OKLAHOMA:
You and each of you are hereby notified that by virtue of a call issued by me on this 25th day of October, 2006, a Special Called Session will be held of the Board of Commissioners of the City of Shawnee, Oklahoma at Shawnee City Hall Commission Chambers, 16 W. 9th, Shawnee, Oklahoma at 5:30 p.m. on October 30, 2006 and you are hereby notified to be present at said meeting.
The purpose of said meeting will be for the purposes of a public forum to discuss septic system issues and proposed septic system regulations within the City of Shawnee.

Upon roll call, Mayor Mills declared a quorum and called the meeting to order.
AGENDA ITEM NO. 1: Public forum regarding septic system issues and proposed septic system regulations within the City of Shawnee.
Community Development Director Mike Southard presented staff’s recommendations regarding proposed septic system regulations. The recommendations, in general, are as follows:
For the installation of new septic systems:
1. Eliminate 400’ lateral line requirement
2. Yield to Building Codes
3. Register Installers for septic systems
4. Require that building permits be obtained.
5. City Code Enforcement Officer will inspect septic system installations
Further requirements for existing systems:
1. Inspect systems bi-annually
2. Have septic tank pumped every 5 years.
3. Replace septic system every 20 years.
4. Redirect drainage away from lateral field.
5. Prohibit parking or driving over lateral field.
Mr. Southard further indicated that all the research data he has found indicates that the average life of septic systems is 20 – 30 years. Mr. Southard stated that he chose to recommend replacement after 20 years as a proactive and precautionary measure.
Additional measures recommended by staff are:
1. Enforcement of 150’ of separation from high water mark
2. Locate new installations away from high water mark
3. Prohibit landscaping, other than grass, over lateral field
4. Have the same requirements for aerobic systems as standard systems
5. Prohibit privies
6. Update language in the lease
Mr. Southard indicated that he would prefer phasing the new requirements in as each lake lease comes up for renewal or is transferred to eliminate a backlog.
Commissioner Schrzan had questions regarding the ability to distinguish between contaminants caused by sewer failure and contaminants occurring from other sources. Utility Director Afsaneh Jabbar addressed this question stating that the sources of contaminants cannot be differentiated, but pointing out that the City has control measurers over septic contaminants, but may not have any control over other contaminant sources. Commissioner Schrzan stated that in his opinion the septic systems should be replaced “as needed” rather than having a 20-30 year replacement requirement.
Mike Southard finished his presentation by stating that “landowners have the right to establish the criteria by which leaseholders must adhere.”
At the conclusion of Mr. Southard’s presentation, the Mayor opened the public forum for citizen input.
The following lake leaseholders spoke regarding this issue. Linda Agee, Jo Davis, Zig Zigler, Ray Chidester, Glen Parsons, Leon Freeman, Julie Ackerman, Don Forsberg, Kenneth Davis, Charles Moore, Keith McBroom and Wolf Gugler. Areas of concern expressed by the leaseholders related to the 20 – 30 year septic replacement requirement and inability to comply with 150’ separation requirement due to leasing “pie-shaped” lots. Most leaseholders asked that the septic replacement be “as needed”.

There being no further business to come before the meeting, a motion was made by Commissioner Schrzan, seconded by Vice Mayor Peterson, that the meeting be adjourned. Motion carried 6-0. (7:35 p.m.)
