BOARD OF CITY COMMISSIONERS PROCEEDINGS
SPECIAL CALLED SESSION
AUGUST 28, 2006 AT 5:30 P.M.

The Board of City Commissioners of the City of Shawnee, County of Pottawatomie, State of Oklahoma, met in Special Called Session in the Commission Chambers at City Hall, 9th and Broadway, Shawnee, Oklahoma, Monday, August 28, 2006 at 5:30 p.m., pursuant to notice duly posted as prescribed by law. Mayor Mills presided and called the meeting to order. Upon roll call, the following members were in attendance.

Others in attendance were city staff, citizens of the community, and Wayne Trotter, Editor of the Shawnee Sun, and Courtney Bryce, Shawnee News Star Reporter.

CALL FOR SPECIAL SESSION OF THE BOARD OF COMMISSIONERS OF THE CITY OF SHAWNEE, OKLAHOMA TO BE HELD ON THE 28TH DAY OF AUGUST , 2006 AT 5:30 CLOCK P.M. AT THE SHAWNEE CITY HALL COMMISSION CHAMBERS, 16 WEST 9TH, SHAWNEE, OKLAHOMA FOR A WORK SESSION TO CONSIDER AND DISCUSS OKLAHOMA CITY (ATOKA) WATER CONTRACT AND WATER SURCHARGE FOR PURCHASE OF WATER FROM OKLAHOMA CITY. .

By virtue of the authority vested in me by Section 2, Article IV of the Charter of the City of Shawnee, Oklahoma, Special Session of the Board of Commissioners of the City of Shawnee, Oklahoma is hereby called to meet at the Shawnee City Hall Commission Chambers, 16 West 9th, Shawnee, Oklahoma at 5:30 p.m. on August 28, 2006 for the purpose of a work session to consider and discuss Oklahoma City (Atoka) Water Contract and water surcharge for purchase of water from Oklahoma City.

You and each of you are hereby notified that by virtue of a call issued by me on this 23rd day of August, 2006, a Special Called Session will be held of the Board of Commissioners of the City of Shawnee, Oklahoma at Shawnee City Hall Commission Chambers, 16 W. 9th, Shawnee, Oklahoma at 5:30 p.m. on August 28, 2006 and you are hereby notified to be present at said meeting.

The purpose of said meeting will be for a work session to consider and discuss Oklahoma City (Atoka) Water Contract and water surcharge for purchase of water from Oklahoma City.

I delivered a true and correct copy to Commissioner Tom Schrzan received in person by Mary Jane Schrzan at 8:50 o’clock a.m. on August 25, 2006.

Commissioner David Daugherty could not be found in the City of Shawnee, Oklahoma on August 24, 2006, and left copy at residence at 4:10 o’clock p.m. on August 25, 2006.

The Commission deviated from the formal agenda and considered Agenda Item No. 2 based on information from staff before considering the contract.

AGENDA ITEM NO. 2: Discussion and consideration of water surcharge for purchase of water from Oklahoma City. (Information to be distributed prior to 8/28/06 meeting)

City Manager Jim Collard and Utility Directory Afsaneh Jabbar gave the staff report and a presentation that consisted of the information and recommendations that addressed the surcharge for purchase of water from Oklahoma City as summarized below:
*Staff recommendation: Charge $1.79 per thousand gallons
*Assumptions
· Contract with OKC on an “as needed” basis
· No surcharge for the first thousand gallons
· Assume a blend with the water from Wes Watkins
· Maintain a minimum Twin Lake level for proper operation
· For ease of operations-need additional storage capacity of 1,060 feet to 1,062 feet
· Water use surcharge of $1.23/unit cost per 1,000 gallons
· Storage surcharge of $0.56/unit cost per 1,000 gallons

The Commission reviewed four water bill samples on how the surcharge costs would be broken down for the residential and commercial users.
After further discussion the options that would be presented to the Oklahoma City Water Utilities Trust for its consideration was put into the following motion.
A motion was made by Vice Mayor Peterson, seconded by Commissioner Daugherty, to accept staff’s recommendation that: 1) charge $1.79 per 1,000 gallons based on the City of Shawnee Demand Availability contract (pay as you use) with Oklahoma City; 2) the first 1,000 gallons of use would be exempt from the surcharge; 3) a storage surcharge for ease of operations; 4) blending with Wes Watkins; 5) that the city staff revisit the water purchase in six months or before and bring a report back to the City Commission; and 6) the water rationing stays in effect. Motion carried 7-0.

AGENDA ITEM NO. 1: Discussion and consideration of Oklahoma City (Atoka) Water Contract. (Please refer to contract in 8/21/06
City Commission Agenda packet, Pgs. 50-117)

In discussion and consideration of the Oklahoma City (Atoka) water contract, staff advised the Commission that Oklahoma City was agreeable to changing the contract if the needed.
A motion was made by Commissioner Schrzan, seconded by Commissioner O’Neal, to accept staff’s recommendation on the water contract to be proposed to the Oklahoma City. Motion carried 7-0.

AYE: Schrzan, O’Neal, Mills, Beck, Peterson, Daugherty, Claybrook
NAY: None

Commissioner Claybrook urged the citizens to be patient with city management in working out a solution to the water situation that has been on-going for several years before this city management was employed with the City.
Mayor Mills allowed a couple of citizen input and advised that this was a work session for the City Commission.




AGENDA ITEM NO. 3: Adjournment

There being no further business to come before the meeting, a motion was made by Commissioner Schrzan, seconded by Vice Mayor Peterson, that the meeting be adjourned. Motion carried 7-0. (6:29 p.m.)
