The Board of City Commissioners of the City of Shawnee, County of Pottawatomie, State of Oklahoma, met in Regular Session in the Commission Chambers at City Hall, 9th and Broadway, Shawnee, Oklahoma, Monday, June 19, 2006 at 5:30 p.m., pursuant to notice duly posted as prescribed by law. Mayor Mills presided and called the meeting to order. Upon roll call, the following members were in attendance.

City Attorney John Canavan announced that the Shawnee Municipal Airport Taxiway Reconstruction bid had been inadvertently omitted from the agenda for opening tonight. He explained that it would be within the rules to open the bids but it could not be awarded until the next meeting when it would be placed on the agenda.

A motion was made by Vice Mayor Peterson, seconded by Commissioner Beck, that Consent Agenda Item No. 1(a-k), be approved as presented. Motion carried 6-0.
Presentation by Mayor Mills of a resolution of appreciation to Brian Davis for 24 years of loyal service to the City of Shawnee.
Resolution No. 6273 was introduced and read into record.
“Resolution No. 6273 entitled “A resolution expressing appreciation to Brian Davis for 24 years of loyal service to the City of Shawnee, Oklahoma; directing that said resolution be spread upon the official records of the City of Shawnee, Oklahoma; and authorizing a copy be presented to Brian Davis.”
A motion was made by Commissioner Beck, seconded by Commissioner Claybrook, that the Title and Resolution No. 6273 be approved. Motion carried 6-0.
Thereupon Resolution No. 6273 was duly passed and adopted.
Presentation of plaque of appreciation to Osyth Downing in memory of Bob Downing.
Mayor Mills presented a plaque of appreciation to Osyth Downing from the Board of City Commissioners in memory Bob Downing, the late City Commissioner of Ward 6.
AGENDA ITEM NO. 3: City Manager’s Presentation of Employee of the Month. (Jared Cooper, Code Enforcement Officer).
City Manager Jim Collard presented a plaque and gift certificate to Jared Cooper, Code Enforcement Officer, as the June employee of the month in recognition of his excellent dedication to the City of Shawnee.
Mr. Cooper was present to accept.
AGENDA ITEM NO. 4: Discuss and consider options for directing staff in dealing with regulations at the lake.
Community Development Director Mike Southard gave an updated report from the last Commission meeting regarding the requirements for lateral lines and septic systems for lakesite leases.
Mr. Southard has done research on shoreline water supply and found that several studies indicate that the same standards applied to regular subdivision regulations should not be applied to the water supply based upon the various type soils and high ground.
It was staff’s recommendation to continue its research due to multiple factors that affect the water supply.
The Commission discussed the importance of protecting the water supply and agreed that further research needed to be conducted.
A motion was made by Commissioner Claybrook, seconded by Commissioner Beck, to place a moratorium on renewals and transfers of lake lease lots that do not have four hundred feet (400 ft.) of lateral lines and septic systems for ninety days (90) to allow the city staff to conduct an analysis to determine the appropriate account of lateral lines due to proximity to the city’s water supply. Motion carried 6-0.
AGENDA ITEM NO. 5: Public hearing and consider an ordinance rezoning property located at northwest corner of Bryan and Independence Streets from R-1; Single Family Residential District; C-1; Neighborhood Commercial and C-1P; Neighborhood Commercial with Conditional Use Permit to P.U.D.; Planned Unit Development with Mixed Uses for use as nursing home, assisted living center, senior living and complimentary light commercial. (Applicant: Fidler Properties, LLC). (Continued from 4/17/06 and 5/15/06 meetings).
It was noted that the Planning Commission had continued this item to its next meeting on July 5, 2006.
A motion was made by Vice Mayor Peterson, seconded by Commissioner O’Neal, to defer the public hearing for the rezoning property located at 1610 North Bryan to its July 17th City Commission meeting. Motion carried. 6-0.
AGENDA ITEM NO. 6: Public hearing and consider an ordinance rezoning property located north of 45th Street between Harrison and Bryan Streets from R-1; Residential District to P.U.D.; Planned Unit Development with the following zoning classifications: R-1; Residential District for use as a residential subdivision. (Applicant: Bryant Builders). (Continued from 5/15/06 meeting)
Mayor Mills declared a public hearing in session to consider an ordinance concerning the rezoning of property located at 45th Street between Bryan and Harrison from R-1 to PUD, Planned Unit Development for use as a residential subdivision.
Mayor Mills asked if any persons wished to appear in favor of or in protest of the rezoning request.
Community Development Director Mike Southard gave the staff report and noted that the Planning Commission had recommended approval of the Woodsong Gardens consisting of +80 residential lots with 20 foot front yard setbacks. There were no formal written protests filed. No others appeared and the public hearing was closed.

AGENDA ITEM NO. 7: Public hearing and consider an ordinance rezoning property located at 414 W. Federal from R-1; Residential District to C-1; Neighborhood Commercial District for prospective office use. (Applicant: Sunita Sitara).
Mayor Mills declared a public hearing in session to consider an ordinance concerning the rezoning of property located at 414 West Federal from R-1 to C-1 for neighborhood commercial.
Mayor Mills asked if any persons wished to appear in favor of or in protest of the rezoning request.

AGENDA ITEM NO. 8: Public hearing and consider an ordinance rezoning property located at 31601 West Lake Road from A-1; Agricultural District to A-1P; Agricultural District with Conditional Use Permit to allow for manufactured home on property. (Applicant: Todd & Chrystal Ring).
Mayor Mills declared a public hearing in session to consider an ordinance concerning the rezoning of property located at 31601 Westlake Road from A-1 to A-1P, to allow for a manufactured home.
Mayor Mills asked if any persons wished to appear in favor of or in protest of the rezoning request.
Community Development Director Mike Southard gave the staff report and was noted that the Planning Commission had recommended approval with the stipulation that it meets the recommended standard as follows:
Conditions for Manufactured House Approval
1. The unit must bear a seal certifying compliance with the Federal Manufactured Construction and Safety Standards as revised on April 1, 1995.
2. The unit is dual sectional with a minimum front width of Twenty-four (24) feet and a minimum floor area of One thousand (1,000) square feet.
3. The unit must be attached to a continuous concrete or concrete block foundation that complies with the Building Code. The foundation must be an excavated and backfilled foundation, enclosed at the perimeter with the finished floor being a maximum of Twenty-four (24) inches above the exterior grade of the lot on the uphill side of the house.
4. The roof must be a gable or hip type construction with at least Class C shingle roofing material. The roof slope must have a vertical rise of Three (3) inches for every Twelve (12) inches of horizontal run with a minimum eave projection and roof overhang of Eight (8) inches, which may include guttering.
5. Covered front and rear porches and site-built steps must be constructed with exterior materials matching the structure.

AGENDA ITEM NO. 9: Public hearing and consider an ordinance rezoning property located at 16113 Hart Road from A-1; Agricultural District to A-1P; Agricultural District with Conditional Use Permit to allow for communication tower on property. (Applicant: Woody Woodrell).
Mayor Mills declared a public hearing in session to consider an ordinance concerning the rezoning of property located at 16113 Hart Road from A-1 to A-1P, with a conditional use permit to allow for a communication tower on the city-owned lake property.

AGENDA ITEM NO. 10: Public hearing and consider an ordinance rezoning property located at 14901 Patterson Road from A-1; Agricultural District to A-1P; Agricultural District with Conditional Use Permit to allow for manufactured home on property. (Applicant: Hiram & Trudy Tabler).

AGENDA ITEM NO. 11: Public hearing and consider an ordinance rezoning property located at 920 E. Wallace from R-1; Single Family Residential District to C-3; Automotive and Commercial Recreation District for use as a shop and storage of heavy equipment. (Applicant: Clayton & Shelli Guinn).
Mayor Mills declared a public hearing in session to consider an ordinance concerning the rezoning of property located at 920 East Wallace from R-1 to C-3, for use as a shop and storage of heavy equipment.
Mayor Mills asked if any persons wished to appear in favor of or in protest of the rezoning request.
Community Development Director Mike Southard gave the staff report and he noted that the Planning Commission had recommended denial and staff had recommended approval since it conforms to the Comprehensive Plan.
A protest petition has been submitted, but it lacked the fifty percent (50%) majority.
Mr. Clayton Guinn, the owner, appeared on behalf of his application.
No others appeared and the public hearing was closed.
After due and careful consideration, Ordinance No. 2266NS was introduced and the title read aloud.

A motion was made by Commissioner Beck, seconded by Vice Mayor Peterson, that the Title and Ordinance No. 2266NS be approved.

AGENDA ITEM NO. 12: Consider approval of final plat for Kickapoo Run Addition located at the southwest corner of 7th & Kickapoo streets (Applicant: Randy Thomason OBO Shawnee Housing Authority.)
A motion was made by Commissioner O’Neal, seconded by Commissioner Schrzan, that the final plat for Kickapoo Run Addition located at the southwest corner of 7th and Kickapoo streets be approved with variances to the cul-de-sac to the west which is closer to the property line than city code (100ft) and developer not to make improvements on Kickapoo Street. Motion carried 6-0.
AGENDA ITEM NO. 13: Consider approval of final plat for Surgical Center at Unity Hospital located at the northwest corner of MacArthur and J.D. Kethley streets. (Applicant: Chuck Skillings OBO Unity Health Center.
A motion was made by Vice Mayor Peterson, seconded by Commissioner Beck, that the final plat for Surgical Center at Unity Hospital located at the northwest corner of Macarthur and J. D. Kethley streets be approved with variances to the sidewalk and right-of-way requirements on MacArthur Street.
Motion carried 6-0.
AGENDA ITEM NO. 14: Presentation by staff and consideration of solid waste charges.
Utility Director Afsaneh Jabbar presented her findings on the contract costs for solid waste services and it was staff’s recommendation to charge the residential customers $10.00 per month.
Upon her findings, Ms. Jabbar informed the Commission that it would cost from $10.00 to $11.l0. She advised that the city now charges its customers $9.50 for solid waste services and a fifty cent ($.50) increase would be suggested based upon the administrative costs incurred by the City that is over what the city charges the residents.
She informed the Commission that since this coming year would be the year for the pilot study to determine if it will be feasible for automated collections or stay at manual collections, it would be reasonable to raise the cost by fifty cents. Other determining factors in the pilot study will involve the spring and fall recycling locations and if more will be added.
A motion was made by Vice Mayor Peterson, seconded by Commissioner O’Neal, that the City charges for residential solid waste services increase from $9.50 to $10.00 per unit per month. Motion carried 4-2.
AGENDA ITEM NO. 15: Presentation and consideration of yield study done by Army Corp of Engineers.
City Manager Jim Collard requested the Commission to consider giving permission for the Army Corp of Engineers to take the lead in the investigation of Shawnee’s water supply resources.
He stated that the Corp has proposed to charge $20,000 to conduct the yield study on the city’s water supply.
Mr. Collard noted that it would cost approximately $40,000 to complete the study that included using data from the Oklahoma Water Resource Board and other pertinent resources.
He noted that the funds would be available from the account for refurbishing the two water towers at Shawnee Twin Lakes and that only one tower would be refurbished this coming year.
After discussion, a motion was made by Commissioner Claybrook, seconded by Commissioner Beck, to approve the Army Corp of Engineers to conduct a yield study on the City’s water supply resources. Motion carried 6-0.

A motion was made by Vice Mayor Peterson, seconded by Commissioner Beck, to accept staff’s recommendation to award the Shawnee Twin Lakes tower rehabilitation for Tower No. 1 only to Ratliff, Inc., Ponca City, Oklahoma, in the base bid amount of $134,000.00 as the lowest and best bid. Motion carried 6-0.

A motion was made by Commissioner Claybrook, seconded by Vice Mayor Peterson, to approve staff’s recommendation to award the bid for the One or More Used Tandem Axle Cab and Chassis to Stewart Wholesale, Oklahoma City, Oklahoma in the amount of $35,000.00 as the lowest and best bid.
Motion carried 6-0.
A motion was made by Vice Mayor Peterson, seconded by Commissioner O’Neal, to defer the bid on the Shawnee Municipal Airport Taxiway Reconstruction to staff for evaluation and recommendation at the next meeting. Motion carried 6-0.

AGENDA ITEM NO. 18: Administrative Reports
Under Administrative Reports, Airport Assistant Manager Jerry Sharp reported that he would have the Airport Advisory Board review the proposals for fuel provider at its meeting this Wednesday and the recommendation would go on the July 3rd City Commission agenda.
City Manager Jim Collard mentioned that there was confusion about the rationing times of watering and he explained the intent of the ordinance.
AGENDA ITEM NO. 19: Citizens Participation (A five minute limit per person)

Under Citizens Participation, Mr. Woody Woodrell, expressed appreciation to the city staff and Commission for approving his request to place a communication tower on lake lease property.
Ms. Julie Ackerman, lake lessee, questioned if the lake residents would be included in the new solid waste contract. Staff responded that the lake lessees were included in the service provided to the city.
Mr. Leon Freeman, lake lessee, commented that there was less than 75 residents in the entire lake area and most leases had only two residents.
AGENDA ITEM NO. 20: Consider an Executive Session to discuss contract negotiations with International Association of Firefighters, Local No. 1628 and Shawnee Police Association Local No. 3 as authorized by 25 O.S. §307(B)(2).
A motion was made by Commissioner Schrzan, seconded by Vice Mayor Peterson, to recess to Executive Session to discuss contract negotiations with International Association of Firefighters, Local No. 1628 and Shawnee Police Association Local No. 3 as authorized by 25 O.S. §307(B)(2). Motion carried 6-0.

AGENDA ITEM NO. 23: Commissioners Comments
Under Commissioners Comments, Commissioner Beck voiced concerns about the unlawful selling of fireworks in the city limits and he requested increased enforcement in addressing the matter.
Vice Mayor Peterson requested to place on the July 3rd City Commission agenda the item of swearing-in of the elected candidate from the July 25th City election to fill the unexpired term for Commissioner of Ward 6.
Ms. Peterson also noted that a performance evaluation by the City Commission on City Manager Jim Collard would be conducted in mid-July.

There being no further business to be considered, a motion was made by Vice Mayor Peterson, seconded by Commissioner Beck, that the meeting be adjourned. Motion carried 6-0. (8:50 p.m.)
