Recommendation: To defer until next meeting.

2) Request from Thomas Schrzan, Aldridge Hotel, 20 E. Ninth, to install a loading and unloading sign in front of the Aldridge Hotel.

Recommendation: To approve request.

3) Request from Thomas Schrzan, Aldridge Hotel, 20 E. Ninth, to install 2 hour parking signs on Union and Ninth streets.

Recommendation: To deny request.

4) Request from Gary Walker, 4107 N. Market, to install a stop sign for southbound traffic at Market and 39th streets.

Recommendation: To deny request.

5) Request from Franklin Wilson, owner of Remember When Antique Shop, 8 W. Main Street, to install 2 hour parking for entire block.

The Centennial Committee proposed four projects to be funded through the State Centennial Commission. The City must submit an invoice within the next 2 weeks to the agency. Each county seat will be given $20,000 to be spent on Centennial projects. The Committee is recommending that $9,097 be allocated to Centennial Park (in front of depot), $7,200 for 12 benches downtown, $500 contribution to the Lousie Fluke Memorial project, and $2,000 to purchase a horse sculpture to paint and place in Woodland Park.

m. Approve recommendation from the Community Service Contracts Review Committee to award the management and operation of the Shawnee Community Center to the Y.M.C.A.

The Planning Commission recommends approval of the Conditional Use Permit to sell beer and alcohol for on-site consumption in the C-4 district. This conforms to both the HyettPalma Study and the Comprehensive Plan.

Public hearing and consider an ordinance rezoning property located east of Harrison Street and south of 45th Street from A-1; Agricultural District to R-1; Single Family Residential District and C-2; Suburban Office District for use as a residential subdivision and commercial use along 45th Street. (Applicant: Mehdi Azimi) Pgs. 93-107

The Planning Commission recommends approval of the rezoning from A-1 to R-1 and C-2. The frontage of the property is proposed to become office while the back portion would become a residential subdivision. This request conforms with the Comprehensive Plan.


8. Public hearing and consider an ordinance rezoning property located at 801 W. Franklin from R-1; Single Family Residential District to R-2; Two Family Residential District for use as duplex housing. (Applicant: Aaron Capps and Chad Self o/b/o Dale Owens). Pgs. 108-120

The Planning Commission recommends approval of the rezoning from R-1 to R-2 allowing for duplexes. This request conforms with the Comprehensive Plan.

9. Public hearing and consider an ordinance amending the Zoning Code of the City of Shawnee relating to manufactured homes. Pg. 121

The Planning Commission has continued this item until the September 6th meeting in order to further study the material and allow for all members to attend. The City Commission should continue the item until the September 18th meeting.

10. Consider request from Sam Bullock for a revocable permit to construct a balcony above the sidewalk at 113½ N. Bell.

The property owner desires to construct a porch to be extended from the building out into the right-of-way and over the sidewalk. The structure would be similar to an awning, but would be structurally sound enough to allow people to assemble above it. A spiral staircase is being proposed from the second floor to the sidewalk below for emergency access.

11. Consider variance request of Dr. Robert Barnard and Thomas P. Tibbetts, IV regarding the Kickapoo Run Subdivision and the requirement of performance bonds. Pgs. 122-123

The Kickapoo Run addition will be wholly owned for 15 years. In order to secure final financing, a building permit must be issued, but a permit cannot be issued until a bond is provided or the infrastructure is in place. The request is to waive the bonding requirement. There are 3 to 5 lots where permits could be issued because all utilities are in place, but occupancy on the remaining lots could be linked to the infrastructure acceptance. Staff recommends granting a variance to the requirement.

Both lot lease payments were due in Aug/Sept of 2005. Three attempts have been made by city staff to secure the lease payment. A fourth notice was mailed on July 28th indicating that this item would be heard by the Commission with a recommendation to revoke the lease for lack of payment.

18. Consider lease agreement with Independent School District I-93 of Pottawatomie County for airport property to be used as Early Childhood Center. Pgs. 176-194

Shawnee public schools is proposing to re-construct the parking lot behind the Shawnee Little Theatre in lieu of lease payments for the parking, driveways, and playground areas. The school building would be located on a three acre parcel along Federal in the middle of Lions Club Park.
