The Planning Commission recommends approval of the rezoning from R-1 and C-1 to commercial PUD. The PUD document allows for light commercial along Independence, a nursing home on Bryan (under construction), and mixed residential uses to the north and east. These residential areas will be apartments, condos and/or detached units, but all will be elderly occupied. Sidewalks will be provided along Bryan and Independence, but the sidewalk in front of the nursing home will be constructed as part of the next construction phase.
5. Public hearing and consider an ordinance rezoning property located at 1801 N. Harrison from R-1; Single Family Residential to C-3; Automotive and Commercial Recreation District for speculative commercial use. (Applicants: Leonard and Sharon Dunn) Pgs. 79-89
The Planning Commission recommends approval of the rezoning from R-1 to C-3. This request conforms to the Comprehensive Plan.
6. Public hearing and consider an ordinance rezoning property located at 1221 N. McKinley from I-2; Light Industrial to PUD; Planned Unit Development based on C-3 zoning requirements for use as a mini storage facility. (Applicant: James McLeod). Pgs. 90-121
The Planning Commission recommends approval of this rezoning from I-2 to PUD based on the C-3 district. The applicant proposes to construct a mini-storage facility on the site that is internally oriented. The exterior walls will act as the perimeter fencing therefore encroaching into the front, side and rear yard setbacks. The PUD mitigates the impact on the adjacent residential area by providing increased landscaping and varying the appearance of the structures. The only entrance will be from the north and all lighting will be internally oriented.
7. Public hearing and consider an ordinance rezoning property located at 1416 N. Harrison from C-3; Automotive and Commercial Recreation District to C-3P; Automotive and Commercial Recreation District with Conditional Use Permit to allow for the on-site consumption of alcoholic beverages in an eating establishment. (Applicant: Jacklyn Vongsouvanh o/b/o Bill Townsend). Pgs. 122-131
The Planning Commission recommends approval of the Conditional Use Permit allowing for the sale of beer and alcoholic beverages in an eating establishment. The previous businesses all held similar permits and staff is unaware of any problems associated with it.
8. Public hearing and consider an ordinance rezoning property located at 7311 N. Harrison from A-1; Agricultural District to C-3; Automotive and Commercial Recreation District for use as a mini storage facility. (Applicant: Doyle Beck) Pgs. 132-140
The Planning Commission recommends approval of the rezoning. The Comp Plan depicts this area as agricultural, but this site and several other industrial sites in the area do not conform with the zoning code. There is already a commercial operation on the site and the applicant desires to expand. This is located in the Industrial Character District and with the widening of SH-18 to five lanes, staff believes that this rezoning complies with the intent of the Comp Plan.
9. Consider approval of final plat for Section 1 of Woodsong Gardens Addition located west of Bryan and north of 45th streets. (Applicant: Bryant Development Company). Pgs. 141-143
The Planning Commission recommends approval of the Final Plat for Section 1 of the Woodsong Gardens Addition. This is an 18 lot section that requires water, sewer and roadway extensions. The preliminary plat has approximately 80 residential lots.
10. Consider approval of final plat of the St. John Addition located at 3610 N. Union. (Applicant: St. John Lutheran Church). Pgs. 144-147
The Planning Commission recommends approval of the final plat for the St. John Addition. This is a single lot subdivision. A water line will be extended for fire suppression and a private sewer lift station will be installed. Sufficient right-of-way is provided for Union and Bell Streets for future improvements.
