SPECIAL CALLED SESSION
MARCH 8, 2004 AT 7:00 P.M.
COMMISSION CHAMBERS, CITY HALL

The Board of City Commissioners of the City of Shawnee, County of Pottawatomie, State of Oklahoma, met in Special Called Session in the Commission Chambers at City Hall, 9th and Broadway, Shawnee, Oklahoma, Monday, March 8, 2004 at 7:00 p.m., pursuant to notice duly posted as prescribed by law. Mayor Harden presided and called the meeting to order. Upon roll call, the following members were in attendance.

Other in attendance included: Interim City Manager Terry Compton, City Attorney John Canavan, Public Works Director James Cole, City Engineer John Krywicki, City Clerk Diana Hallock, Shawnee News-Star Reporter Carol Cole, Shawnee Sun Reporter Wayne Trotter, and five men representing BFI Waste Services, LLC.
The Call for said meeting was entered upon the records by the City Clerk, said Call being as follows:




CALL FOR SPECIAL SESSION OF THE BOARD OF COMMISSIONERS OF THE CITY OF SHAWNEE, OKLAHOMA TO BE HELD ON THE 8th DAY OF MARCH, 2004 AT 7:00 O’CLOCK P.M. IN THE COMMISSION CHAMBERS OF SHAWNEE CITY HALL, 16 W. 9TH, SHAWNEE, OKLAHOMA FOR THE PURPOSE OF SAID SPECIAL MEETING.

By virtue of the authority vested in me by Section 2, Article IV of the Charter of the City of Shawnee, Oklahoma, a Special Session of the Board of Commissioners of the City of Shawnee, Oklahoma is hereby called to meet at the Shawnee City Hall, City Commission Chambers, Shawnee, Oklahoma at 7:00 p.m. on March 8, 2004 for the purpose of considering authorizing staff to advertise for bids for solid waste disposal services, including all options.

TO THE BOARD OF COMMISSIONERS OF THE CITY OF SHAWNEE, OKLAHOMA AND THE CITY MANAGER:

You and each of you are hereby notified that by virtue of a call issued by me on this 5th day of March, 2004, a Special Session will be held of the Board of Commissioners of the City of Shawnee, Oklahoma in City Commission Chambers of Shawnee City Hall, 16 W. 9th, Shawnee, Oklahoma at 7:00 p.m. on March 8, 2004, and you are hereby notified to be present at said meeting.

AGENDA ITEM NO. 1: Consider authorizing staff to advertise for bids for solid waste disposal services, including all options.

Interim City Manager Terry Compton issued handouts to the Commission and explained that the City had been losing $8,261 monthly or $99,128 annually on solid waste disposal contract with BFI.
The monthly billing for the City based on $8.50 per month is $80,750 but the cost of service is $8.18 for the contract rate and flow rate charge for $77,710 per month.
He reported that Administration costs are another $6,038 per month; fall cleanup charges $1,938 per month; and the monthly recycling charge is $3,325 per month for a total of $89,011 or a loss of $8,261 per month.
Mr. Compton explained that solid waste services are operated with “Enterprise funds” and according to state statutes those funds should not lose money.
The Commission discussed options for a rate increase or cancel the current contract with BFI and re-advertise. It was noted that the rates had not been raised to the customers for 18 years.
In discussion, several of the Commissioners relayed that the citizens they surveyed were satisfied with BFI’s services.
Looking at the situation from the point of view of a customer, Commissioner Claybrook reasoned that it would be more palatable for the rate to be raised one dollar than to have services reduced to once-a-week garbage pickup.
Concluding discussion, Commissioner Weaver commented that twice weekly service was unusual and it seemed reasonable to increase the rate to keep the same quality of service.




A motion was made by Commissioner Claybrook, seconded by Commissioner Weaver, to stay with the current BFI service contract and increase the monthly rate from $8.50 to $9.50 per residence to become effective April 1, 2004. Motion carried.

There being no further business to come before the meeting, a motion was made by Vice Mayor Downing, seconded by Commissioner Peterson, that the meeting be adjourned. Motion carried.
